    Terms of sale

    1. Scope

    These Terms and Conditions of Sale apply, without restriction or reservation, to all sales made by ONEMORE VENTURES LLC (the “Seller”) to consumers and non-business purchasers (the “Customer” or “Customers”) wishing to purchase the products offered for sale by the Seller (the “Products”) through zimeka.com.

    They set out the conditions governing orders, payments, deliveries and the management of returns of Products ordered by Customers.

    These Terms and Conditions of Sale may be supplemented by specific conditions displayed on the Website before a transaction is completed.

    These Terms and Conditions of Sale apply to the exclusion of any other conditions, including conditions applicable to sales through physical shops or other distribution channels.

    They are available at all times on zimeka.com and, where applicable, take precedence over any previous version or conflicting document.

    These Terms and Conditions of Sale may be amended. The version applicable to a Customer’s purchase is the version displayed on the Website on the date the order is placed.

    2. Products offered

    The Products offered for sale on zimeka.com include:

    • Throws and blankets for the home, including fleece, faux fur, sherpa, wool, cotton, knitted, chunky-knit and heated throws in a range of colours and sizes.

    The main characteristics of the Products, including their specifications, illustrations, dimensions and capacities, are presented on zimeka.com.

    The Customer must review this information before placing an order. The Customer is responsible for selecting Products that are suitable for their requirements.

    We make every reasonable effort to ensure that photographs and graphics displayed on zimeka.com accurately represent the Products. However, minor variations may occur, particularly because of differences in screen displays. This does not affect the Customer’s statutory rights where a Product is not as described.

    The Customer should consult the description of each Product for information about its properties, essential characteristics and estimated delivery times.

    Contractual information is provided in English and will be confirmed no later than when the Customer’s order is accepted.

    Product offers are subject to availability, as indicated when the order is placed.

    3. Seller’s contact details

    The Seller’s contact details are:

    ONEMORE VENTURES LLC – Zimeka

    1603 Capitol Ave

    Ste 413 E477

    Cheyenne, WY 82001

    United States

    Email: contact@zimeka.com

    Telephone: +33 7 87 12 80 50

    In accordance with the UK General Data Protection Regulation and the Data Protection Act 2018, Customers may have rights of access, rectification, erasure, restriction, objection and data portability in relation to their personal information. These rights may be exercised by contacting the Seller at the postal address above or by email at contact@zimeka.com. Where reasonably necessary, the Seller may request additional information to verify the identity of the person making the request.

    4. Acceptance of the Terms and Conditions of Sale

    By submitting an order, the Customer accepts these Terms and Conditions of Sale without restriction or reservation.

    The Customer confirms that they have the legal capacity required to enter into a contract and purchase the Products offered through zimeka.com.

    5. Orders

    5.1 Placing an order

    The Customer selects the Products they wish to order through zimeka.com in accordance with the ordering process displayed on the Website.

    Before submitting the order, the Customer can review the order details and total price and correct any errors. The Customer is responsible for checking that the order information is accurate and correcting any errors before submitting it.

    An order is submitted through zimeka.com when the Customer accepts these Terms and Conditions of Sale by selecting the relevant checkbox and confirms the order. This confirmation constitutes acceptance of these Terms and Conditions of Sale and the Website’s Terms of Use.

    The Customer’s submission of an order constitutes an offer to purchase the Products. The contract becomes binding when the Seller sends the Customer an email confirming that the order has been accepted. Payment may be taken when the order is submitted or accepted.

    Each order submitted by the Customer and accepted by the Seller forms a distance contract between the Customer and the Seller.

    Subject to evidence to the contrary, information recorded in the Seller’s computer systems may be used as evidence of transactions with the Customer.

    The Seller reserves the right to cancel or refuse an order where there is a legitimate reason to do so, including an unresolved dispute concerning payment for a previous order. If payment has already been taken for a cancelled order, the relevant amount will be refunded.

    The Customer can track the progress of their order using the tracking number sent by email when the order is dispatched.

    The Seller supplies Products to consumers and non-business purchasers for personal use. It does not intend to supply Products for resale. The Seller may therefore refuse orders containing unusually large quantities of the same Product, including orders containing more than five identical items, where it reasonably believes that the order is intended for commercial resale.

    5.2 Changes to an order

    Requests to change an order will only be accepted where reasonably possible and must be sent to contact@zimeka.com as soon as possible and, where possible, at least one day before the expected dispatch date.

    If a requested change cannot be accepted and the order is cancelled by agreement, any corresponding amount paid by the Customer will be refunded within 14 days, unless the Customer chooses an available exchange or store credit. This does not affect the Customer’s statutory cancellation rights.

    5.3 Cancelling an order before dispatch

    The Customer may request cancellation of an order before dispatch by contacting contact@zimeka.com. We will make reasonable efforts to stop the order. If the order has already been dispatched, the Customer may exercise their statutory right to cancel in accordance with section 10.

    6. Prices

    Products are supplied at the prices displayed on zimeka.com when the order is placed. Prices for the UK market are displayed in pounds sterling (GBP) and include VAT where applicable.

    Prices take account of any discounts offered by the Seller through the Website.

    Prices remain fixed during the validity period displayed on the Website. The Seller may change prices outside that period. Price changes do not affect orders that have already been accepted.

    Standard delivery is free. Any additional charge for an optional delivery service will be clearly displayed before the Customer submits the order.

    The total amount payable by the Customer will be displayed before the order is submitted.

    7. Payment terms

    The full price is payable when the Customer places the order using one of the secure payment methods made available at checkout, which may include:

    • Visa, Mastercard, American Express and Maestro payment cards;
    • Apple Pay, Google Pay, PayPal and Klarna.

    The availability of payment methods may vary. The methods currently available will be displayed at checkout.

    Card payments cannot normally be reversed by the Customer once authorised, except where permitted by law, including in cases of fraudulent or unauthorised use. Customers should contact their card issuer or payment provider if they believe a payment was unauthorised.

    8. Delivery

    Products ordered through the UK version of zimeka.com are delivered within the United Kingdom.

    The order cut-off time is 8:00 p.m. London time, Monday to Friday. London time is either Greenwich Mean Time (GMT) or British Summer Time (BST), depending on the time of year. Orders placed after the cut-off time will begin processing on the following working day.

    Orders are processed and dispatched within 1 to 2 working days, excluding weekends and public holidays. The estimated delivery time after dispatch is 5 to 8 working days.

    The estimated total delivery time is 6 to 10 working days. Delivery will be made to the address provided by the Customer when placing the order.

    Delivery occurs when the Customer, or a person identified by the Customer other than the carrier, takes physical possession or control of the Product. Unless otherwise stated or where Products are unavailable, Products in the same order may be delivered together.

    The Seller will make reasonable efforts to deliver Products within the estimated times stated above. Delivery times are estimates and may be affected by circumstances outside the Seller’s reasonable control.

    Unless a different delivery period has been expressly agreed, Products will be delivered without undue delay and no later than 30 days after the contract is entered into. If delivery is not completed within the agreed period or within the applicable statutory period, the Customer may have the right to require delivery within an additional appropriate period or cancel the contract in accordance with UK consumer law.

    If the contract is cancelled because of a failure to deliver within the legally required period, the Seller will refund all amounts paid for the affected Products without undue delay.

    If a delivered Product does not conform to the contract, the Seller will provide the remedies required under the Consumer Rights Act 2015, as described in section 11.

    The Seller bears the risk of loss or damage during transport until the Customer, or a person nominated by the Customer other than the carrier, takes physical possession of the Products.

    9. Transfer of ownership and risk

    Ownership of the Products will pass to the Customer once the Seller has received payment in full and the Products have been dispatched, unless applicable law requires otherwise.

    Regardless of when ownership passes, the risk of loss or damage remains with the Seller until the Customer, or a person nominated by the Customer other than the carrier, takes physical possession of the Products.

    10. Right to cancel

    Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Customer normally has 14 days beginning on the day after receiving the Product to notify the Seller that they wish to cancel the contract, without providing a reason.

    If an order contains several Products delivered separately, the cancellation period begins on the day after the final Product is received.

    After notifying the Seller of the cancellation, the Customer must return the Products without undue delay and no later than 14 days after the date on which the cancellation was communicated.

    The Customer may inspect and handle the Products only as they would reasonably be allowed to do in a shop. The Seller may reduce the refund to reflect any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the Products.

    Where reasonably possible, Products should be returned complete and with their original packaging, accessories and instructions. The Customer should include their order number or other proof of purchase. The absence of original packaging or a paper invoice does not, by itself, remove the Customer’s statutory rights.

    The right to cancel may be exercised by using the cancellation form in Appendix 2 or by sending any other clear statement expressing the Customer’s decision to cancel to contact@zimeka.com.

    Where the Customer exercises the right to cancel within the statutory period, the Seller will refund the price of the cancelled Products and the cost of the least expensive standard delivery option offered by the Seller. As standard delivery is free, no outbound delivery charge will normally be refundable. The Customer is responsible for the direct cost of returning unwanted Products unless the Seller agrees otherwise.

    The Seller will issue the refund without undue delay and no later than 14 days after receiving the returned Products or receiving evidence that the Products have been sent back, whichever occurs first.

    The refund will be made using the same payment method used for the original transaction unless the Customer expressly agrees otherwise. No fee will be charged for issuing the refund.

    Statutory exceptions to the right to cancel may apply, including to personalised Products and sealed Products that are not suitable for return for health protection or hygiene reasons once unsealed.

    11. Seller’s responsibilities and statutory rights

    Products sold through zimeka.com must comply with applicable UK law and are intended for normal personal and domestic use unless otherwise stated.

    Under the Consumer Rights Act 2015, Products must be:

    • of satisfactory quality;
    • fit for any particular purpose made known to the Seller before purchase;
    • as described and consistent with any model or sample provided;
    • installed correctly where installation forms part of the contract.

    If a Product does not meet these requirements, the Customer may be entitled to statutory remedies. These rights apply independently of the cancellation right and any commercial warranty.

    Where applicable, the Customer may exercise the short-term right to reject a faulty Product within 30 days of receiving it and request a refund.

    After the initial 30-day period, or where the Customer chooses not to exercise the short-term right to reject, the Customer may normally request a repair or replacement. The Seller may provide the alternative remedy if the requested option is impossible or disproportionately expensive.

    If a repair or replacement is impossible, unsuccessful, or not completed within a reasonable time and without significant inconvenience, the Customer may be entitled to a price reduction or the final right to reject the Product and obtain a refund.

    If a fault becomes apparent within six months after delivery, it will generally be presumed to have existed at the time of delivery unless the Seller can demonstrate otherwise or that presumption is inconsistent with the nature of the Product or fault.

    The Seller will pay or reimburse reasonable return costs for Products confirmed to be faulty, damaged, incorrect or not as described. Customers should contact contact@zimeka.com before returning such Products so that appropriate instructions can be provided.

    Refunds for Products that are faulty or do not conform to the contract will be issued without undue delay and, where required by law, within 14 days after the Seller agrees that the Customer is entitled to a refund.

    The Seller will not be responsible for problems caused by:

    • use of a Product in a manner that is unlawful in the country in which it is used;
    • misuse, use for an undisclosed professional purpose, negligence, failure to follow care instructions, normal wear and tear, accidental damage or events outside the Seller’s reasonable control.

    Nothing in these Terms limits or excludes the Customer’s statutory consumer rights or any liability that cannot lawfully be excluded.

    12. Protection of personal information

    Personal information requested from the Customer is necessary to process orders, take payment, arrange delivery, provide customer support and issue invoices or other transaction records. This information may be shared with service providers responsible for processing, fulfilling, delivering, managing or taking payment for orders.

    Personal information submitted through zimeka.com will be processed in accordance with the UK GDPR, the Data Protection Act 2018 and the Website’s Privacy Policy.

    Subject to the conditions and exceptions provided by applicable law, the Customer may have rights of access, rectification, erasure, restriction, objection and data portability in relation to their personal information. These rights may be exercised as described in the Privacy Policy available on zimeka.com.

    13. Intellectual property

    The content of zimeka.com belongs to the Seller, its licensors or its partners and is protected by the Copyright, Designs and Patents Act 1988 and other applicable UK and international intellectual property laws.

    Any unauthorised reproduction, distribution, publication, modification or commercial exploitation of all or part of this content is prohibited and may constitute an infringement of intellectual property rights.

    14. Change of circumstances

    A change in economic or commercial circumstances will not, by itself, release either party from its contractual obligations. This section does not affect any statutory consumer rights or the provisions relating to events outside a party’s reasonable control.

    15. Events outside reasonable control

    Neither party will be responsible for a failure or delay in performing an obligation where that failure or delay results from an event outside the party’s reasonable control.

    If such an event affects delivery, the Seller will contact the Customer as soon as reasonably possible and take steps to minimise the delay. If there is a substantial delay, the Customer may contact the Seller to cancel the affected order and receive a refund for Products paid for but not received.

    16. Governing law and language

    These Terms and Conditions of Sale and the transactions arising from them are governed by the laws of England and Wales.

    These Terms and Conditions of Sale are written in English. If they are translated into another language, the English version will prevail to the extent permitted by law.

    If the Customer resides in Scotland or Northern Ireland, the Customer retains the benefit of any mandatory consumer protections applicable in their place of residence.

    17. Disputes

    If a dispute arises, the Customer should first contact the Seller at contact@zimeka.com so that the parties can attempt to resolve the matter directly.

    If the dispute cannot be resolved directly, either party may bring proceedings before the competent courts. A Customer residing in England or Wales may bring proceedings in the courts of England and Wales. A Customer residing in Scotland or Northern Ireland may bring proceedings in the courts of the part of the United Kingdom in which they reside.

    18. Alternative dispute resolution

    If a dispute cannot be resolved through the Seller’s internal complaints process, the parties may consider using an appropriate alternative dispute resolution procedure where both parties agree to do so.

    Unless the Seller separately identifies an approved alternative dispute resolution provider on zimeka.com, ONEMORE VENTURES LLC is not committed to using a specific alternative dispute resolution provider.

    19. Customer acceptance

    By placing an order through zimeka.com, the Customer accepts these Terms and Conditions of Sale and agrees to pay for the Products ordered.

    Nothing in these Terms requires the Customer to waive statutory rights or prevents the Customer from relying on any mandatory protection available under UK consumer law.

    Appendix 1 – Summary of statutory rights

    This Appendix provides a general summary of certain statutory rights under UK consumer law. It does not replace the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or any other applicable legislation.

    Under the Consumer Rights Act 2015, goods supplied by a trader to a consumer must be of satisfactory quality, fit for purpose and as described.

    If goods do not conform to the contract, the consumer may have the following remedies, depending on the circumstances:

    • a short-term right to reject the goods and receive a refund, normally within 30 days of delivery;
    • a right to request a repair or replacement;
    • a right to a price reduction or a final right to reject the goods if a repair or replacement is unavailable, unsuccessful or not provided within a reasonable time and without significant inconvenience.

    Where the final right to reject is exercised more than six months after delivery, the Seller may in certain circumstances make a reasonable deduction to reflect the Customer’s use of the goods, except where the law does not permit such a deduction.

    In England and Wales, court proceedings for breach of contract must generally be brought within six years. Different limitation periods may apply in Scotland or in particular circumstances.

    These statutory rights are not affected by any commercial warranty offered with a Product.

    Appendix 2 – Model cancellation form
